Google Does It Again: How Did An Employee Record Secret AI Information and Even Start His Own Company in China?

Linwei Ding, a Chinese national residing in Newark, California, has been arrested and indicted by a federal grand jury on four counts of theft of trade secrets, linked to a plan to steal proprietary information from Google LLC related to artificial intelligence (AI) technology. Announced by Attorney General Merrick B. Garland during a "Fireside Chat" at the 39th National Institute on White Collar Crime by the American Bar Association in San Francisco, Ding, 38, is accused of transferring sensitive trade secrets and other confidential information from Google's network to his personal Google Drive account while secretly affiliating with companies in China within the AI industry. Ding was arrested on the morning of the announcement in Newark. The Justice Department has expressed its firm stance against the theft of AI and other advanced technologies that could compromise the national security of the United States.

Details of the Indictment:


The indictment details how Ding, employed at Google as a software engineer since 2019, had access to confidential information related to Google's hardware infrastructure and software, as well as the AI models and applications they support. Ding allegedly began uploading trade secrets to a personal Google Cloud account starting May 21, 2022, transferring over 500 unique files with confidential information by May 2, 2023. In a surprising twist, it was revealed that another employee facilitated the deceit by using Ding's badge to simulate his presence at Google's facilities while he was actually in China. This collaboration underscores a significant security breach and raises questions about the effectiveness of Google's internal controls.

Secret Affiliations:


Ding is alleged to have secretly affiliated with two technology companies based in the People's Republic of China. Starting June 13, 2022, Ding reportedly received several emails indicating he had been offered the position of Chief Technology Officer at an emerging technology company in China. Additionally, it is indicated that Ding founded his own technology company in the AI and machine learning industry, acting as CEO and promoting the development of a software platform designed to accelerate machine learning workloads.
